Operator: Miles, operated by Erik Lyons, a sole proprietor doing business as "Miles," San Diego, California ("Miles," "we," "us").

By accessing or using Miles (the web application at trymiles.app and any related application we provide), you agree to these Terms of Use. If you do not agree, do not use Miles.

1. What Miles is

Miles is a location-aware audio companion that narrates stories about the places you are near — neighborhoods, landmarks, people, and local history — in and around San Diego, California. Miles is currently in testing (beta). Access is by invitation: we provide a tester access code to a limited group, and features, content, and availability may change at any time without notice.

2. Safety — read this first

3. Eligibility and access

4. AI-generated content — it can be wrong

Miles' stories are researched and narrated with the help of artificial intelligence (AI) systems, and some stories are generated during your tour. AI-generated content can contain errors, including errors of fact, date, name, and detail, and information about places and businesses may be out of date. Content is provided for entertainment and general educational interest only. It is not professional advice of any kind, and you should not rely on Miles for decisions about safety, travel, money, or anything else that matters — verify independently.

The narrator "Miles" is a fictional, AI-voiced character. Miles is not a real person, a licensed tour guide, or a historian.

5. Acceptable use

You agree not to:

6. Intellectual property

Miles — including the application, the story library, texts, audio, the Miles character, name, and likeness — is owned by the operator and protected by applicable intellectual-property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use Miles for your own personal, non-commercial enjoyment. No other rights are granted.

If you give us feedback (suggestions, bug reports, story ideas), you grant us a royalty-free, perpetual right to use it without obligation or compensation.

7. Third-party services and places

Miles uses third-party services (including Google Maps Platform / Places and Google Gemini) and refers to real places, businesses, and organizations. Those places and businesses are not affiliated with or endorsed by Miles, and their names and trademarks belong to their owners. Information about them may change without our knowledge; check with the place directly before visiting.

8. No warranties

Miles is provided "as is" and "as available," in beta, without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, reliability, or uninterrupted availability. Tours depend on GPS signal, network coverage, and third-party services outside our control.

9. Limitation of liability

To the maximum extent permitted by law, the operator will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Miles, and the operator's total liability for any claim arising from Miles will not exceed US $100. Nothing in these Terms limits liability that cannot be limited under applicable law.

You use Miles while traveling at your own discretion and risk, as described in Section 2.

10. Changes, suspension, and termination

We may change these Terms, change or discontinue any part of Miles, or suspend or terminate your access at any time. If we make material changes to these Terms, we will post the updated version at this page with a new effective date. Continuing to use Miles after a change means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of the State of California. Any dispute arising from Miles or these Terms will be brought in the state or federal courts located in San Diego County, California, and you consent to their jurisdiction.
